The Appeal Court, Abuja has reinstated Ayogu Eze as the governorship candidate of the All Progressives Congress (APC) in Enugu state.
Recall that the federal high court had ruled that George Ogara is APC’s authentic governorship candidate in Enugu after he approached the court for relief, faulting the party’s primaries.
But a three-man panel of the Appeal court on Thursday set aside that judgement.
The panel led by Abdul Aboki held that the federal high court had no competence because the suit brought before it had exceeded the time limit granted by the constitution.
Mr. Ogara had filed the suit on November 5 while the party held its governorship primaries on October 4.
The panel said having filed the suit after the mandatory 14 days stipulated by section 258(9) of the 1999 constitution for re-election matters, the lower court erred in hearing the matter.
The panel therefore set aside the lowerc ourt’s ruling and affirmed Eze as the party’s candidate in Enugu State.
