Olanipekun, Agabi, 45 Other SANs Storm CCT To Defend CJN Onnoghen In Infamous Trial

At least 47 Senior Advocates of Nigeria (SANs) on Monday stormed the Code of Conduct Tribunal to defend Chief Justice Walter Onnoghen in the opening hearing in the false assets declaration infamous case prefered against him by the government of President Muhammadu Buhari.

With the 2019 presidential roughly one month away, majority of Nigerians are of the opinion that Onnoghen’s trial is politically motivated.

The Federal Govt alleges that Mr Onnoghen failed to declare a series of bank accounts linked to him for several years, in violation of the code of conduct law for public officeholders.

Curiously, the petition containing the allegations was sent to the Code of Conduct Bureau on January 9, investigations were snapped up in a matter of hours and the Code of Conduct Tribunal fixed today (Monday) for commencement of trial.

The petition was written by Denis Aghanya, a former political aide to Mr. Buhari.

Majority of senior lawyers hold the view that the CJN can not be tried by any court of law without his first appearing before the National Judicial Council (NJC) for disciplinary hearing and possible sanctions, in accordance with Section 158(1) of the 1999 Constitution. They cite the The judicial pronouncements in the cases of FGN Vs Justice Sylvester Ngwuta of the Supreme Court (January 9, 2018) and Justice Ngajinwa Vs FGN 2017 at the CCT as the position of the law on the matter.

Like most Nigerians, the Bar sees Onnoghen scheduled trial as unlawful and an attempt by the executive branch of government to pocket the Judiciary and erode its independence ahead of the 2019 elections.

Little wonder, at least 47 senior advocates of Nigeria turned out to defend Mr. Onnoghen, who was however not in court due to improper service of the charges against him by the prosecution.
